    1. Introduction

    This Service User Agreement (“Agreement”) governs the relationship between MB&U Company Ltd (MBU Properties & Management), its clients, and users of its services, including but not limited to property owners, tenants, buyers, sellers, and investors (collectively, “Users”).

    By using MBU Properties & Management services or platform, Users agree to be bound by this Agreement. This Agreement applies to all services provided including property rental management, sales brokerage, property valuation, and compliance advisory.

    2. Parties

    • Service Provider: MB&U Company Ltd, operating as MBU Properties & Management, a Rwandan registered company.
    • User / Client: Any individual or entity engaging MBU Properties & Management for property-related services.

    3. Scope of Services

    MBU Properties & Management provides the following services:

    1. Property Letting & Rental Management

    • Tenant sourcing and screening
    • Lease agreement preparation
    • Rent collection and reporting
    • Maintenance coordination
    • Rent arrears management

    2. Property Sales Brokerage

    • Property marketing (online/offline)
    • Buyer sourcing and verification
    • Transaction negotiation and documentation
    • Closing coordination

    3. Property Valuation Services

    • Market assessments
    • Investment advisory valuations
    • Pre-sale and bank valuation support

    4. Compliance & Documentation Advisory

    • Title verification support
    • Land registration guidance
    • Lease drafting assistance
    • Property tax compliance advisory

    Note: Services may be provided through digital platforms, physical property inspections, or combination of both.

    4. User Obligations

    Users agree to:

    • Provide accurate, complete, and current information.
    • Comply with applicable laws, regulations, and contractual obligations.
    • Respect MBU Properties & Management policies, including payment obligations and service terms.
    • Not use the platform or services for unlawful, fraudulent, or prohibited purposes.

    Landlords, tenants, buyers, and sellers specifically agree to conduct proper due diligence and uphold their respective contractual obligations.

    5. Fees and Payments

    • Users agree to pay all applicable service fees, commissions, or charges as communicated in advance.
    • Rental Management Commission: 8%–12% of monthly rent.
    • Sales Commission: 3%–5% of property sale value.
    • Valuation & Advisory Services: Fixed fees or project-based charges.
    • Premium Listings / Marketing Services: Additional optional fees.

    All fees must be paid in full and on time. Non-payment may result in suspension or termination of services.

    6. Lease & Rental Agreement Clause (for Rental Users)

    Where rental management services are provided:

    • MBU Properties & Management will prepare and manage the lease on behalf of the landlord.
    • Tenants are required to comply with the terms of the lease including payment of rent, property maintenance, and adherence to property rules.
    • Landlords must ensure legal ownership and right to lease the property.
    • Any disputes between landlords and tenants are to be resolved in accordance with Rwandan law. MBU Properties & Management may mediate but is not a party to the lease unless explicitly agreed.

    7. Property Sales & Brokerage Clause (for Buyers/Sellers)

    • MBU Properties & Management facilitates property sale transactions and acts as a broker.
    • All buyers and sellers must verify property ownership and legal status prior to transaction completion.
    • The company is not responsible for the outcome of property sales beyond brokerage and advisory services unless otherwise agreed in writing.

    8. Intellectual Property

    All materials, content, and tools provided by MBU Properties & Management remain the company’s intellectual property. Users may not copy, reproduce, or distribute materials without prior written consent.

    9. Confidentiality

    • Users and the company agree to maintain confidentiality of sensitive information received during the course of service provision.
    • Personal and financial data will be handled in accordance with the Privacy Policy.

    10. Limitation of Liability

    MBU Properties & Management is not liable for:

    • Losses arising from property transactions
    • Misrepresentation by any third party
    • Non-performance by tenants, buyers, or sellers
    • Indirect, incidental, or consequential damages

    Users assume full responsibility for their actions and decisions relating to property transactions.

    11. Termination

    • This Agreement may be terminated by either party with prior written notice.
    • Termination does not relieve Users of payment obligations for services rendered.
    • MBU Properties & Management may suspend or terminate services in case of breach of this Agreement.

    12. Governing Law & Dispute Resolution

    • This Agreement shall be governed by the laws of the Republic of Rwanda.
    • Any disputes shall be resolved in the competent courts of Rwanda.
    • Parties agree to attempt mediation before legal action where possible.
